2). You agree that any trading, investment or hedging strategies based on research done with our data, or data we recommend is your sole responsibility and we will remain held harmless.
3). You agree and acknowledge that no data is ever perfect and all data includes bad ticks and inaccuracies. Therefore you agree that we make no quality or accuracy assurances of the data and that accuracy and quality measures or judgments will be your responsibility.
4). In addition you agree that simulated/backtested trades may or may not have been executed exactly as the backtest indicates if you had been trading at that date and time.
5). You also agree that backtested and simulated results do not imply and cannot with any certainty guarantee future profitability or even similar performance.
6). You agree that you are purchasing the data as is.
7). You agree that you and we reserve the right to terminate any services mid stream for what ever reason.
8). You agree that we mark our data products with a small identifiable pip mark within the data to identify any copying or reselling attempts.
9). You agree that a purchase gives you the user the right to install the data on one non-virtual network.
10). You agree that a purchase does not give the purchaser the right to give away the data or use the data to improve current data which will then be offered as a fee for data or free data product.
11). You understand data is delivered in a copy-able electronic media format and therefore all sales are final. It is incumbent upon the purchaser to make all necessary information inquiries to determine whether the data is suitable for the purchaser(s) need.
12). Furthermore you understand and agree to all terms and conditions listed/stated above and wish to proceed with business with ForexTickData.com.
